  1. ELIGIBILITY: This promotion is open legal residents of the United States of America, age 18 or older as of date of entry. Employees, officers, directors, and volunteers of Digital Surgeons, Inc. (“Sponsor”); employees, officers, directors and volunteers of Digital Surgeon’s respective parent companies, subsidiaries, and affiliates, and Digital Surgeon’s advertising and promotion agencies; the immediate family members (mother, father, sister, brother, husband, wife, daughter, son, step-father, step-mother, step-daughter, step-son, step brother, step-sister, half-brother, half-sister) of any of the foregoing persons living in the same household; and persons who do not possess a valid Social Security number (or ITIN) are not eligible. All federal, state and local laws and regulations apply. Void where prohibited by law. Any awards and/or giveaways shall be void to entrants in Rhode Island (if prize value is over $499 USD), all U.S. Territories, overseas military installations and commonwealths (e.g., Guam and Puerto Rico) and where otherwise prohibited by law.

  2. HERE’S HOW IT WORKS: Either prior to or within that time, entrants must download the free ShootLocal application to their iPhone or iPad, or access the application via its website, and become a registered user. Each user must register with a valid email address in order to be eligible to participate. To participate in the contest, entrants post locations to the ShootLocal database. Locations must not already exist in the database; must adhere to the ShootLocal Terms of Service; must be relevant, accessible and of appropriate quality for professional purposes; and must include a title, description, at least one photo, at least three relevant tags, and the location’s address and contact information. Locations must be posted in their entirety by 12:00am CDT, October 15, 2012 to be eligible. Incomplete entries will be disqualified. Digital Surgeons and its agents reserve the right to disqualify any entry, as well as delete any entry from its database, for any reason and at their sole discretion, without notification to the entrant.

  3. THIRD-PARTY JUDGING: All eligible entries will be judged based on their individual merits by three independent judges, who will be selected by the sponsor. One entry will be selected as the winner in each of the following categories: Best Overall Location, Best Natural Landscape, Best Rustic Location, Best Contemporary Location, Best Industrial Location, Best Public Property, Best Private Property and Most Unusual Location. The judges will also select 10 entries to compete for the Community’s Choice award, which will be determined based on the criteria in section 4.

The entrant submitting the entry winning the Best Overall Location category will be designated as the ShootLocal Photographer of the Year, effective October 15, 2012 through October 14, 2013.

Once the entries are judged, Sponsor will notify potential winners by email associated with the registered user account. Sponsor will make 3 attempts to contact each potential winner via email within 3 business days from the date the winner selection was accomplished. If Sponsor is unable to reach a potential winner within this time frame, he/she will be disqualified and Sponsor may, at its sole discretion, choose to award the prize to an alternate Entrant. Potential winners will be provided with prize verification documents (i.e., Affidavit of Eligibility, Release of Liability and, if legally permissible, a Publicity Release) via email. Such documents must be completed and returned with original signatures within 7 calendar days from the date of email notification, as determined by Sponsor. Noncompliance within these time periods or return of any prize/prize notification as undeliverable will result in disqualification by Sponsor and an alternate winner will be selected, time permitting. Odds of winning will depend on the number of eligible entries received.

  1. COMMUNITY’S CHOICE. The 10 entries selected to compete for the Community’s Choice award will be posted to the Competition web page where ShootLocal visitors to the Competition page will be asked to choose their favorite entry. Individuals of the public casting votes on the web page will only be eligible to place a vote for a single entry. Any attempt to circumvent the voting system will result in revocation of voting rights and potential disqualification of the entry. The entry receiving the greatest number of votes will be determined the winner of the Community’s Choice award.

  2. PRIZES & VALUE: 9 Prizes: One (1) Canon Rebel T31 camera, two (2) Lensbaby Composer Pro lenses, six (6) Lensbaby Scout with Fisheye lens. Prizes will be shipped via overnight express, signature required, within approximately 2-weeks after winner verification documents are received and verified. Total value of all prizes available to be won is $4,500.

  3. GENERAL RULES: No substitution, assignment, or transfer of prize by winners permitted. Winners will be responsible for all federal, state and local income taxes and may be required to certify their Taxpayer Identification Number on IRS Form W-9 if requested. By accepting prize, winners and their heirs, executors and administrators release and agree to hold said universities, the Sponsor, and the respective directors, officers, employees, volunteers, agents, advisers, and assigns of all of the foregoing parties harmless against any and all claims and liability arising out of winning, receipt of, or use of a prize. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this contest or use or redemption of any prize. Acceptance of prize constitutes permission to the Sponsor and its agencies to use winner's name, photograph and/or likeness for purposes of advertising, promotion, or trade without further compensation, unless prohibited by law. By participating in this contest, entrants agree to be bound by these Official Rules and the decisions of Sponsor, which are final. In the event there is a discrepancy or inconsistency in any sweepstakes materials, the Official Rules and ShootLocal Terms of Use shall prevail, govern and control. All material submitted becomes the sole property of Sponsor and will not be returned. Sponsor and the other parties are not responsible for any typographical or other error in the printing of the offer, administration of the sweepstakes, or in the announcement of the prizes. In no event will more than the stated number of prizes be awarded. Claims may not be resolved through any form of class action. The parties are not responsible for any technical problems, delays in processing transactions, non-receipt of a transaction, computer, electronic malfunction, human error, malfunctions of telephone lines, computer systems, servers, providers, hardware, software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. The Sponsor and additional parties are not responsible for any damage to any participant’s computer system, software, or imaging equipment related to or resulting from participation or downloading any materials in this promotion. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Entries that are suspected of being fraudulent (e.g., those using robotic, automatic, programmed or similar methods of participation) will be disqualified, based on determinations made solely by Sponsor. Sponsor reserves the right to prohibit the participation of an individual if fraud, abuse, or tampering is suspected, if winner verification documents are obtained or submitted illegitimately or if an entrant fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. Sponsor reserves the right to cancel, suspend, modify any method of entry if fraud, abuse, misconduct or technical failures inherent to that method of entry destroy the integrity of the program; or if a computer virus, bug or other technical problem corrupts the administration, security or proper administration of the program as determined by Sponsor in their sole discretion. In the event of termination of any method of entry, all remaining drawings will be conducted from among all eligible entries received from such method of entry prior to termination (of such method of entry) and all remaining entries received from non-terminated methods of entry. Proof of submitting entry will not be deemed proof of receipt by Sponsor.

Participation constitutes an Entrant’s full and unconditional agreement to abide by these Official Rules and by Sponsor’s decisions relating to the Contest and the ShootLocal Terms of Use. The decisions of the Sponsor in regards to all matters pertaining to the Contest and any subsequent contests, initiatives or programs deriving from such are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein or otherwise set forth in any updates to these Rules. Official Rules are subject to change, from time to time at the discretion of the Sponsor. Entrants should review the Official Rules on a regular basis.

By entering into the Contest, you are entering into an electronic contract with Sponsor to be bound by these Official Rules governing the Contest. In addition, you are agreeing to the Terms & Conditions of Use governing use of ShootLocal, pursuant to which you make certain representations to Sponsor and grant Sponsor certain license rights to use your Contest entry and other submitted content. Furthermore, you are agreeing to use of certain of your personal information by Sponsor as set forth in the Privacy Policy and as otherwise outlined below.

  1. DURATION: The contest period begins at 12:00am, May 15, 2012 and continues to 12:00am October 15, 2012. Sponsor is not required to provide any notice upon determining to terminate Contest.

  2. PERMISSION TO USE NAME/LIKENESS. Any Entrant, by submitting an entry, grant permission to have his or her name, city, photograph submissions and/or likeness used worldwide in any manner the Sponsor may deem appropriate for advertising, trade and/or promotional purposes without additional compensation or right of review, including without limitation, posting the Entrant’s name on the Sponsor web sites unless prohibited by law.

  3. RELEASE AND INDEMNIFICATION. By participating in this Program, an Entrant agrees to release and to indemnify and hold harmless Sponsor, its parent and affiliated companies, and each of its or their respective officers, directors, employees and agents (collectively, the “Released Parties”) from any claim, actions, rights, liability, injury, death, loss or damages to Entrant or any other person or entity, including without limitation, damage to personal or real property, caused in whole or in part, directly or indirectly, by participation in this Program (or related activities), the use of the Entrant’s photograph(s) in the Contest, or the acceptance, possession or use/misuse of any prize awarded to Entrant (including any travel or activity related to the prize). This release shall include, but shall not be limited to, actions arising out of any claim of copyright or trademark infringement made as a result of content in an entry. Entrant, by uploading photographs for consideration in the Contest, also asserts that Entrant has the authority to use the name, likeness, content, material, subject and topic of any image depicted in such photographs and grants to the Released Parties permission to upload the video onto the Contest web site, and Shoot Local application and unlimited usage of the photograph(s) for publicity, advertising, trade or promotional purposes in any media or manner, now known or hereafter devised, worldwide, without further payment, consideration, notice or approval.


  5. RESPONSIBILITY OF RELEASED PARTIES. The Released Parties shall not be responsible for: (1) any incorrect or inaccurate information, whether caused by an Entrant, a printing error or by any of the equipment, hardware, software or programming associated or used with the Contest; (2) technical errors, defects, delays or failures of any kind, including without limitation malfunctions, interruptions or disconnections in communications lines, Internet or website access, hardware or software; (3) digital or electronic disruptions, e.g., viruses other security breaches; (4) unauthorized human intervention, e.g., hacking; (5) technical or human error which may occur in connection with any aspect of the Contest; (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from an Entrant’s participation in the Contest, and (7) any unauthorized access to, copying or downloading materials from any other website, or receipt or use of any prize.

  6. ELECTRONIC COMMUNICATIONS: By submitting your Contest entry, you agree to do business with Sponsor electronically. By agreeing to do business electronically, you (i) consent to the electronic communication and delivery of all documents related to the Contest, (ii) agree that review of your submission is a binding form of consideration for you, the Entrant, to be governed by these Official Rules, (iii) represent that you have Internet access and a valid e-mail address enabling you to receive communications and documents electronically, and (iv) represent that you have a printer or other device to print or otherwise save communications and documents including, without limitation, these Official Rules and that you have, in fact, printed or otherwise saved a copy of these Official Rules for your records.

  7. WINNERS: To receive a list of winners by email, send an email to with WINNERS as the subject line. Requests must be received by 10/15/2012. Winners list will be sent after the winners have been verified.

  8. DISPUTES/CHOICE OF LAW: Each Entrant agrees that any and all disputes, claims or causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Hartford, Connecticut without reference to its choice of law rules. Each Entrant waives their right any other forum that they may be entitled to in light of their current or future domiciles.
